Uluslararası Ceza Mahkemesinin 5 Şubat 2021 tarihli kararında bir mahkemenin kararının sadece savcının soruşturmanın coğrafi sınırlarını belirlediği ve bu kararın uluslararası hukuktan kaynaklanan diğer soruları önceden saptamadığı vurgulanmaktadır. Ayrıca, bu kararın mevcut aşamada yürütülen bir soruşturmanın açılması ile ilgili olduğu ve gelecekteki yargı yetkisi konularının, savcı tarafından tutuklama veya mahkemeye çağrı talepleri veya bir devlet veya şüpheli tarafından statünün belirli maddelerine dayalı itirazlarla gündeme gelebileceği belirtilmektedir.
In the decision of the International Criminal Court dated February 5, 2021, it is emphasized that a court’s decision only determines the geographical boundaries of the prosecutor’s investigation and that this decision does not predetermine other questions arising from international law. It is also stated that this decision relates to the opening of an investigation carried out at the current stage and that future jurisdictional issues may be raised by requests for arrest or subpoena by the prosecutor or objections by a state or suspect based on certain articles of the statute.
